Regulated compensation, for a transparent service
Notary fees in France are set by law and regulated by decree. These are not freely set fees, but rather regulated costs, the same regardless of the notary you choose.
A notary's compensation includes:
- Emoluments: These correspond to the legal fee for official acts (sale, donation, inheritance, etc.).
- Disbursements: These are amounts paid in advance by the notary on your behalf (registration fees, publication, official documents…).
- Taxes and duties: Paid to the State and local authorities (e.g. transfer taxes).
🔎 The notary collects these fees, but the majority is transferred to the tax authorities.

Free fees: compensation adapted to the task
For certain acts or services not subject to regulated rates, notaries may charge free fees, defined in agreement with the client.
This applies in particular to:
- Complex legal support (estate planning, international law, taxation…)
- Acts not covered by decree (company bylaws, specific legal consultations…)
- Analytical or audit assignments (succession planning, transmission strategies, etc.)
These fees are set according to time spent, complexity, and added value.
A fee agreement is proposed to you at the start of the engagement.
